Texas and New Mexico Car Wreck and Truck Wreck Cases

Commonly asked questions about Texas and New Mexico car wreck and truck wreck cases

  1. Should I accept payment from the insurance company?

Before you accept any payment for cash any check, you should review your options with a knowledgeable attorney, like the attorneys at Sommerman & Quesada, LLP. Insurance companies are in the business of making money which means that they usually attempt to have you accept a lesser payment than would get if you had filed a personal injury lawsuit.  It may be tempting to accept an initial offer from the insurance company; but it is not always in your best interest.

  2. If I file a lawsuit, what am I allowed to sue for?

When you file a lawsuit, you are requesting the court to award you damages. In a car wreck or truck wreck lawsuit, you could be awarded damages for your medical bills, lost wages, future lost wages, property damage, and pain and suffering, physical impairment, and disfigurement.

  3. What if I don’t want to go to court?

Frequently, car wreck and truck wreck cases reach settlements outside of court. This is especially true when victims have experienced lawyers who are expert negotiators defending their rights. Our attorneys at Sommerman & Quesada LLP have more than 85 years of combined legal experience and are committed to protecting our clients' best interests. We will never force a client to go to court if they do not want to.

  4. If I Was Injured In A Motorcycle Accident While Not Wearing A Helmet, Can I Still Collect Damages?

Yes, you can still file a personal injury claim after a motorcycle accident even if you were not wearing a helmet at the time of the collision and suffered a head injury or brain injury. Whether or not you were wearing a helmet has nothing to do with who caused the accident and who is ultimately at fault for your crash.

  5. What Are The Texas Motorcycle Helmet Laws?

In Texas, motorcycle riders must wear a helmet if they are under the age of 21. If a motorcycle rider is over the age of 21, has taken a motorcycle training and safety course, and has proof of health insurance, wearing a helmet while riding is optional. While motorcycle helmets are not required for many riders in Texas, helmets have been proven to minimize injuries and prevent death in the case of a motorcycle accident.

  6. If I've been in a car wreck will my insurance go up?

Only if its your fault. If the incident is not your fault, then no.
